Pathuis Management BV is aware of the importance of protecting personal data and strives to process these data in accordance with the General Data Protection Regulation (GDPR). This statement describes which personal and business data we process and what rights you have as a data subject.
1. Processing of personal data
1.1 Types of personal data
We collect the following personal data:
- Name
- Address
- Email address
- Phone number
- Job title
1.2 Purposes of processing
Personal data are processed for:
- Preparing quotations
- Sending mailings and newsletters
- Managing customer records
1.3 Legal grounds
Processing is based on the following grounds:
- Consent: obtained by entering into the agreement, through email confirmation of the assignment.
- Necessary for the performance of a contract: processing is necessary to perform the agreement with the client.
- Legal obligation: processing is required by law in certain situations.
- Legitimate interest: processing is based on a legitimate interest of Pathuis Management BV, including:
- Improvement of services — by processing personal and business data we can optimise our services and better align them with our clients’ needs.
- Compliance with contractual obligations — to meet the contractual obligations we have with our clients, including delivering agreed services and ensuring quality and continuity.
2. Processing of business data
2.1 Types of business data
We receive and retain the following business data from the client (and their clients):
- Company name
- Address
- Loading and unloading addresses
- Shipment information
- Shipment rates
- Carriers used
- Other relevant business data for reporting purposes
2.2 Purposes of processing
- Generating BI reports
- Making reports available online
2.3 Legal grounds
Processing of business data is based on the same grounds as under 1.3, with the following additional legitimate interests:
- Efficiency and effectiveness — processing business data such as shipment information enables us to generate BI reports that help clients make informed decisions.
- Safety and security — by managing data on an external server and providing secure access to reports, we ensure that sensitive information remains protected against unauthorised access.
3. Retention period
If you have requested information from us, we retain your data for at most seven years after our last contact, provided you have not unsubscribed in the meantime. Even if we have received a quotation request but have not become your client, we retain your personal data for seven years after our last contact. This period corresponds to the statutory period during which we are required to keep our records for the Dutch Tax Administration.
4. Security
We have taken appropriate technical and organisational measures to protect personal and business data against unauthorised access, use, modification or deletion. These measures include:
- Encryption
- Firewalls
- Access control
5. Data subject rights
As a data subject you have the following rights regarding your personal data:
- Right of access — the right to know which personal data are processed about you.
- Right to rectification — the right to have inaccurate or incomplete personal data corrected.
- Right to erasure — the right to have your personal data erased, unless there is a legal reason to retain them.
- Right to restriction of processing — the right to restrict the processing of your personal data.
- Right to data portability — the right to receive your personal data in a structured, commonly used and machine-readable format.
- Right to object — the right to object to the processing of your personal data.
6. Collection and interpretation of data
As a data processor we collect, process and interpret data in accordance with the purposes and instructions set out in the agreement. We make every effort to carry out data processing as accurately and carefully as possible. However, we accept no liability for damage arising from incorrect interpretations or decisions based on incomplete, inaccurate or outdated data provided by or on behalf of the Data Controller. The Data Controller remains responsible at all times for the accuracy, completeness and lawfulness of the data provided to the Processor.
7. Information about the client's client
We process business data of the client’s client exclusively for the purposes for which they were collected and in accordance with applicable law. We do not share these data with third parties, unless this is necessary for the performance of our services or when we are legally obliged to do so.
